Terms of Service

1. Agreement

These Terms of Service govern your access to and use of PromptShip, operated by Pyde Technologies ("PromptShip", "we"). By creating an account or using the service, you agree to these terms.

2. The service

PromptShip is a deployment platform. It builds and runs code from your Git repositories, provisions managed databases, and submits mobile builds to third-party app stores on your behalf. We provide the platform on an "as is" basis. Availability, features, and pricing may change over time.

3. Your account

You are responsible for keeping your account credentials and API tokens secure. You are responsible for all activity on your account, including actions taken by your team members, AI agents, or integrations acting on your behalf.

4. Acceptable use

You agree not to use PromptShip to build, deploy, or distribute:

  • Malware, ransomware, spyware, or code designed to damage or gain unauthorized access to systems.
  • Phishing sites, credential harvesters, or content impersonating other services or brands you do not own.
  • Content that is illegal in the jurisdictions where it is hosted or served, including child sexual abuse material, non-consensual intimate imagery, or content that incites violence.
  • Spam, unsolicited bulk messaging, or systems designed to evade rate limits or abuse detection.
  • Cryptocurrency mining, distributed compute for profit, or other workloads whose primary purpose is to consume platform resources.
  • Content that infringes intellectual property or privacy rights of others.
  • Any activity that violates applicable laws, including export controls and sanctions.

You will not attempt to probe, scan, or test the vulnerability of PromptShip systems other than your own resources, or circumvent authentication, rate limits, or quotas.

5. Your content

You retain all ownership of code, content, and data you upload or deploy through PromptShip. You grant us a limited license to store, process, build, and serve your content solely as needed to operate the service on your behalf.

6. Mobile app submissions

When you use PromptShip to submit iOS or Android apps, you authorize us to act on your behalf with the App Store Connect and Google Play Console accounts you have connected. You remain responsible for compliance with Apple's and Google's developer program policies and for the content of your submitted builds.

7. Billing

Paid plans are billed through our payment processor. Pricing and included resources are listed at /pricing. You are responsible for all charges incurred on your account, including infrastructure, bandwidth, and build-minute usage. We may suspend service for overdue balances.

8. Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these terms, that we reasonably suspect of abuse, or that are inactive for extended periods. On termination, your apps and data will be deleted on our standard schedule, and you are responsible for exporting anything you wish to keep.

We may immediately suspend access, remove specific content, or terminate accounts without prior notice in cases of serious violations, suspected fraud, security threats, or imminent harm to the platform or other users. No refunds are due for terminations resulting from violations of these terms.

9. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the service will be uninterrupted, error-free, or secure against every threat.

10. Limitation of liability

To the maximum extent permitted by law, PromptShip is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim arising from the service will not exceed the amount you paid us in the three months preceding the claim.

11. Indemnification

You will defend, indemnify, and hold harmless PromptShip, Pyde Technologies, and their directors, officers, employees, and agents from and against any third-party claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to:

  • Your content, including code, data, and applications you deploy through the service.
  • Your use of the service in violation of these terms or applicable law.
  • Your violation of any third-party right, including intellectual property or privacy rights.
  • Actions taken by your team members, AI agents, or integrations acting on your behalf.

12. Changes

We may update these terms at any time. For material changes that reduce your rights or materially change your obligations, we will provide reasonable prior notice (typically 30 days) via email or in-product notice. Non-material changes, including clarifications, corrections, and additions reflecting new features, take effect immediately on publication. Continued use of the service after changes take effect constitutes acceptance.

13. Governing law and disputes

These terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales, without regard to conflict of law principles. You and PromptShip agree that the courts of England and Wales have exclusive jurisdiction to resolve any dispute arising from these terms or the service, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

14. Miscellaneous

Entire agreement. These terms, together with our Privacy Policy, constitute the entire agreement between you and PromptShip regarding the service and supersede any prior agreements.

Severability. If any provision of these terms is held unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

No waiver. Our failure to enforce any right or provision of these terms will not be considered a waiver of that right or provision.

Assignment. You may not assign or transfer these terms or any rights under them without our prior written consent. We may assign these terms in connection with a merger, acquisition, or sale of assets.

Force majeure. Neither party is liable for failure or delay in performance caused by events beyond its reasonable control, including natural disasters, war, terrorism, labor disputes, internet outages, or acts of government.
